Definitions
For clarity within these shadows:
- Fracture: The digital experience on thefracture.ai, including its website, applications, and related services.
- Relic: A unique, encrypted identifier stored locally in your browser to track your progress within Fracture.
- Misuse: Any unauthorized access, distribution, modification, or exploitation of Fracture’s content, code, or systems, including but not limited to hacking, distributing malware, or violating intellectual property rights.
- You/Traveler: Any individual accessing or interacting with Fracture.
1. The Agreement Beneath the Surface
By accessing Fracture or clicking "Accept" on our terms prompt, you enter into this binding agreement. You may review these terms at any time at thefracture.ai/terms.
You are not merely a customer; you are a traveler in this digital realm. However, this journey is governed by the following rules:
- You may not misuse, copy, alter, or reverse-engineer Fracture.
- Fracture is offered as-is. We make no guarantees regarding its availability, functionality, or the outcomes of your journey.
- All content, code, design, and relic systems are the exclusive property of thefracture.ai.
- Some elements of Fracture may require payment. All purchases are final unless otherwise stated or required by law. We do not offer refunds except where mandated by applicable legislation.
- We reserve the right to modify, suspend, or terminate any part of Fracture at any time. We will endeavor to notify you of significant changes through the experience or via email if provided.
Payment Terms: Payments are processed by third-party providers such as Stripe or PayPal. Their terms and conditions apply. All fees are in USD, inclusive of applicable taxes. In case of disputes or chargebacks, please contact us within 30 days at fracture@thefracture.ai.
2. What We Remember of You
Fracture respects your privacy. We do not track your activities across the internet. However, to facilitate your journey, we store certain data locally on your device:
- Your Relic, a unique identifier, is stored in your browser using encrypted local storage. This allows you to resume your progress without server-side tracking.
- We use local storage and essential cookies to maintain your session and preferences. These include:
- Storing your Relic
- Maintaining your session
- Remembering your progress
- If you contact us for support and provide personal data, we use it solely to respond to your inquiry. Such data is deleted within 30 days unless retention is required by law (e.g., for accounting purposes).
We do not sell, share, or monetize your data. Your identity remains your own.
Data Retention: Local storage data persists until you clear your browser or request deletion. Support-related data is retained for 30 days post-resolution, unless longer retention is legally required.
Data Security: We employ industry-standard encryption (e.g., AES-256) to protect your Relic and any transmitted data. Nevertheless, no system is entirely secure, and you acknowledge the inherent risks of online interaction.
Third-Party Services: Fracture may utilize third-party services for hosting, payment processing, or analytics. These providers are contractually obligated to protect your data and do not use it beyond providing their services. A list of third-party processors is available upon request.
Age Restriction: Fracture is intended for users aged 18 or older. In jurisdictions where a higher age is required, that limit applies. We do not knowingly collect data from users below the applicable age. If you believe a minor has interacted with Fracture, please contact us to request deletion.
3. Your Rights in the Shadows

Depending on your location, you may have certain rights regarding your personal data:
- European Union, UK, and Similar Jurisdictions: Under GDPR and equivalent laws, you have the right to access, rectify, delete, or restrict processing of your data, as well as data portability and the right to object.
- California, USA: Under CCPA, you have the right to know what data is collected, delete it, and opt out of data sales (though we do not sell data).
- Other Jurisdictions: Similar rights may apply under laws like Canada’s PIPEDA or Australia’s Privacy Act.

You also have the right to lodge a complaint with your local data protection authority if you believe your rights have been violated.
4. The Law Beyond the Myth
These terms are governed by the laws of Israel. Any disputes arising from or related to these terms or your use of Fracture will be subject to the exclusive jurisdiction of the courts in Tel Aviv, Israel.
5. This May Shift
Fracture is an evolving experience, and these terms may change accordingly. We will notify you of material changes via a prominent notice within Fracture or by email (if provided) at least 14 days before the changes take effect. Your continued use of Fracture after such changes constitutes acceptance of the updated terms.

6. Disclaimers and Limits of Liability
Fracture is provided "as-is" and without any warranties, express or implied. We do not guarantee that Fracture will be uninterrupted, error-free, or free from harmful components.
To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages arising from your use of Fracture, including but not limited to emotional, psychological, or cognitive effects, except where such damages are caused by our gross negligence or willful misconduct.
No Medical Advice: Fracture is not a diagnostic tool, medical service, or substitute for psychological or therapeutic care. It is a narrative-based digital experience designed for reflection and creative exploration.
Our total liability to you, if any, will not exceed the amount you have paid to us (if applicable), unless otherwise required by law.
7. Force Majeure
We are not liable for any failure or delay in performing our obligations under these terms due to events beyond our reasonable control, including but not limited to natural disasters, wars, pandemics, cyberattacks, or government actions.
8. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
